Declaration by Account Holder/Applicant
PGG Wrightson Rewards/Terms and Conditions
Definitions
- “Reward” means all products and services redeemable for Points and provided by the
Programme and includes retail goods, entertainment, travel, special experiences,
and services and such other products and services that PGG Wrightson may add from
time to time.
- “Programme Enrolment Date” will be the day on which the Card application is accepted
by PGG Wrightson.
- “Enrolment Year” means a twelve-month period commencing on the Programme Enrolment
Date and any anniversary of the Programme Enrolment Date.
- “Vouchers” means certificates issued by PGG Wrightson that may be exchanged for
goods or services from a Supplier.
- “Programme” means the PGG Wrightson Rewards Programme.
- “Card” means the PGG Wrightson American Express Card.
- “PGG Wrightson” means PGG Wrightson Limited and includes its assigned successors
and subsidiaries and “Wrightson” and its trademarks .
- “Cardmember” means the holder of either a Basic or an Additional Card where the
“Basic Card” is the first Card issued on an Account and an “Additional Card” is
a Card issued subsequent to the Basic Card on the same Account. A “Basic Cardmember”
means the holder of a Basic Card and an “Additional Cardmember” means the holder
of an Additional Card.
- “Account” means a PGG Wrightson account on which the Card is issued.
- “Supplier” means a supplier of a Reward listed in this catalogue.
- The singular includes the plural and vice versa.
Eligibility
- Upon issue of a Card, the Account on which the Card is drawn will be enrolled in
the Programme entitling the Cardmember to start earning Points for spending as described
under the heading “Points Accrual in the Programme”.
- Additional Cards issued are enrolled to earn Points for the Basic Cardmember. Additional
Cardmembers may not enrol separately in the Programme.
Points Accrual In The Programme
- Each Cardmember will accrue Points for every dollar spent using the Card, subject
to the exclusions listed immediately below:
- Express cash
- Cash advances
- American Express Travellers cheque and gift cheque purchases
- Charges for dishonoured cheques
- The Card annual membership fee
- Finance and service charges, including but not limited to Card Account Finance charges
- Liquidated damages
- Purchases through PGG Wrightson other than those from PGG Wrightson Farm/Rural Supplies
Stores for off-the-shelf in store items
- Bulk item purchases made through PGG Wrightson Farm/Rural Supply stores, such as
fertiliser, seed, fuel and grain and items on special promotion
- any other exclusions specified from time to time by PGG Wrightson.
- When a Cardmember obtains a refund or reimbursement for charges previously incurred
(for example, returned merchandise) a ‘credit’ is issued to the Account in the amount
of the reimbursement granted. Such credits posted including, but not limited to
those arising from returned goods or services, will reduce the Points accrued on
the Account. In addition, no points will accrue as a result of account adjustments
resulting from billing disputes or otherwise.
- Points accrued to an Account do not constitute property of a Cardmember, are not
transferable by operation of law or otherwise to any other person or entity and
cannot be transferred to any other Account or similar Points programme.
- If a credit posted to any Account reduces the Points balance below the minimum required
to redeem points for Rewards, PGG Wrightson reserves the right to decline the Cardmember’s
request to redeem points for Rewards.
- Points accrued in the Programme have no cash or monetary value.
Points Redemption
- An Account must be within its terms of trade and a Card not cancelled by PGG Wrightson,
American Express or the Cardmember (except as provided below) at the time of a redemption
request.
- Points accrued on an Account can only be redeemed by a Basic Cardmember and not
by Additional Cardmembers.
- By redeeming a Reward the Cardmember releases PGG Wrightson from any and all liability
regarding the redemption or use of any Reward or other participation in the Programme.
- Any dispute concerning goods or services received as a Reward shall be settled between
the Cardmember and the Supplier. PGG Wrightson will not be responsible or liable
for resolving such dispute or for the dispute itself.
- PGG Wrightson is not responsible for lost or stolen Rewards, Vouchers, certificates
or tickets.
- Rewards and Vouchers do not represent currency or monetary value, are not exchangeable,
refundable, replaceable or transferable and must be redeemed within six months
of issue.
- Information supplied on the redemption of Rewards may be used by PGG Wrightson or
the Supplier for administrative and marketing purposes.
- The rate at which PGG Wrightson Rewards Points may be converted to Air New Zealand
Airpoints DollarsTM may vary without notice.
Redeeming Rewards
- Upon accumulating the required number of Points, Cardmembers may redeem their points
for the Rewards detailed in this catalogue until the catalogue is withdrawn, replaced
or until PGG Wrightson specifies.
- All Rewards are subject to availability. Restrictions may apply as to when a Reward
can be redeemed. The redemption procedure and the terms and conditions of each Reward
are detailed in this catalogue and on the Voucher issued to the Cardmember for the
Reward. The specific terms and conditions of a Reward are binding upon a Cardmember
and shall in the event of inconsistency supersede these Terms and Conditions.
- Any additional products or services or further arrangements made in conjunction
with the Supplier in connection with any Reward will be the sole responsibility
of the Cardmember.
- The issue of a Voucher does not constitute a reservation. The Cardmember is responsible
for making all reservations and/or notifying the Supplier
PGG Wrightson Points Account
- If an Account is not within its terms of trade PGG Wrightson may cancel enrolment
in the Programme or forfeit Points accrued. Participation may also be cancelled
or points forfeited as a result of a Cardmember’s failure to adhere to the terms
and conditions governing the use of the Card.
- If participation in the Programme is cancelled Points accrued will be forfeited.
- Rewards Points may not be transferred from one account to another. Any variation
on this condition is at the sole discretion of PGG Wrightson Limited.
- All Points have a limited life of three years.
Should those points not be redeemed within the subsequent three year period they
will become void 36 months after they were recorded. These expired points will then
be deducted from the points balance recorded in the Cardmember’s account.
General
- PGG Wrightson reserves the right to terminate, change or vary the Programme at any
time without notice.
- PGG Wrightson reserves the right to cancel, change or substitute any Reward, these
Terms and Conditions and any specific term and condition of a Reward or its redemption
at any time with or without prior notice.
- Only Basic Cardmembers can initiate a request for conversion of Points. Request
can be made by phoning PGG Wrightson or contacting a PGG Wrightson store.
- Fraud or abuse in respect of the Programme or conversion of Points may result in
forfeiture of points or cancellation of an Account or Cards issued on that Account.
- Additional Cardmembers may not redeem Vouchers without supplying written authority
from the Basic Cardmember.
- All questions or disputes regarding eligibility for the Programme or the eligibility
of Points for accrual or conversion of points will be resolved by PGG Wrightson
at its sole discretion.
- The determination of liability for any government levies or taxes or other expenses
or charges arising out of the accrual or conversion of Points in the Programme shall
be the Cardmember’s sole responsibility.
- PGG Wrightson’s failure to enforce a particular Term or Condition does not constitute
a waiver of that Term or Condition by PGG Wrightson.
- Rewards may differ from those shown in this catalogue. Reward items are subject to availability.
Specifications, style, graphics and colours of Rewards may change without notice.
Foreign currency charges;
If you make a Charge in a currency other than New Zealand dollars, that Charge will
be converted into New Zealand dollars. The conversion will take place on the date
the Charge is processed by American Express, which may not be the same date on which
you made your Charge as it depends on when the Charge was submitted to American
Express. If the Charge is not in U.S. dollars, the conversion will be made through
U.S. dollars, by converting the Charge amount into U.S. dollars and then by converting
the U.S. dollar amount into New Zealand dollars. If the Charge is in U.S. dollars,
it will be converted directly into New Zealand dollars. Unless a specific rate is
required by applicable law, you understand and agree that the American Express treasury
system will use conversion rates based on interbank rates that it selects from customary
industry sources on the business day prior to the processing date, increased by
a single conversion commission of 2%. If Charges are converted by third parties
prior to being submitted to us, any conversions made by those third parties will
be at rates selected by them.
For your information, the conversion commission remains unchanged.
